
Arbitration arose from a very basic necessity in the middle ages, primarily in London. The king's court was becoming too formalistic and out of touch with the business community (and its customs). The cost of attorneys was very high (sound familiar?). What was a businessman to do?
The parties agreed to let a third party neutral (an arbitrator) decide the dispute without resorting to the courts. There was usually one arbitrator, but sometimes they chose more than one (usually an odd number so they wouldn't get a tie vote). The arbitrator might be chosen from their guild (or livery company), probably a master (sometimes called a liveryman). If the dispute was simple, the arbitrator tended not to charge. Now there is even a London livery company for arbitrators, the Worshipful Company of Arbitrators.

We arbitrate disputes (more of a judge's role). Since we are a smaller law firm, we don't have conflicts that prevent us from hearing and deciding a case fairly. Arbitrators in large law firms not only have to consider whether or not they represent the parities to the arbitration, but they have to consider whether or not any of their OTHER clients would object to them making a ruling that might affect their interests in a similar future dispute. We have acted as arbitrators for literally hundreds of different disputes. | |

Most arbitration decisions are confidential. While we post names of disputes we arbitrate on our web site, we only disclose the decision if it is publicly available otherwise. While most other arbitrators do not do this, we feel it is important so you can determine if we have a conflict of interest.
Nowadays, the parties chose a mechanism to pick an arbitrator. Our attorneys are on a variety of arbitral institution lists, such as:
If the parties did not provide for an appointment mechanism and cannot agree on an arbitrator, a court can appoint an arbitrator.
